Terms of Service

You must be at least 18 years of age and capable of entering into a legally binding agreement to use the Service. By using the Service, you represent and warrant that you meet these requirements.

To access the Service, you must register for an account. You agree to:

• Provide accurate, current, and complete registration information
• Maintain the security of your password and not share credentials with unauthorised parties
• Notify us immediately at admin@prismavoices.com of any unauthorised use of your account
• Accept responsibility for all activity that occurs under your account

You agree to use the Service only for lawful purposes and in accordance with these Terms. You must not:

• Use the Service to make or facilitate illegal, harassing, deceptive, or fraudulent calls
• Impersonate any person or entity or misrepresent your affiliation
• Violate any applicable telemarketing or do-not-call regulations
• Attempt to gain unauthorised access to any part of the Service or its infrastructure
• Reverse engineer, decompile, or disassemble any part of the Service
• Use the Service to transmit malware, spam, or other harmful content
• Resell or sublicense access to the Service without our prior written consent

The Service integrates with third-party providers including Twilio, Vapi, WhatsApp Business, and calendar services. Your use of these integrations is subject to those providers' terms and policies. We are not responsible for the availability or performance of third-party services.

All content, features, and functionality of the Service — including software, text, graphics, logos, and AI models — are the exclusive property of Prisma Voices or its licensors and are protected by intellectual property laws. You are granted a limited, non-exclusive, non-transferable licence to use the Service for your internal business purposes only.

You retain ownership of all data, configurations, and call recordings you submit through the Service (“Your Content”). By submitting Your Content, you grant Prisma Voices a limited licence to process and store it solely as necessary to provide the Service. You are solely responsible for the accuracy and legality of Your Content.

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. You are responsible for obtaining any necessary consents from callers or end users before recording or processing their information through the Service.

THE SERVICE IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT DEFECTS WILL BE CORRECTED.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, PRISMA VOICES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, REVENUE, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL CUMULATIVE LIABILITY SHALL NOT EXCEED THE AMOUNTS PAID BY YOU TO US IN THE THREE MONTHS PRECEDING THE CLAIM.

You agree to indemnify, defend, and hold harmless Prisma Voices and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising from: (a) your use of the Service; (b) Your Content; (c) your violation of these Terms; or (d) your violation of any applicable law or third-party rights.

We reserve the right to suspend or terminate your account at our sole discretion, without notice, for conduct that we determine violates these Terms or is otherwise harmful to us, other users, or third parties. Upon termination, your right to use the Service ceases immediately. You may cancel your subscription at any time as described in our Refund & Cancellation Policy.

These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law principles. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts located in India. We encourage you to first contact us at admin@prismavoices.com to resolve disputes informally.

We reserve the right to modify these Terms at any time. We will provide notice of material changes by updating the effective date and notifying you via email or in-app notification. Your continued use of the Service following such notice constitutes your acceptance of the revised Terms.
